MDAS POS
End-User License Agreement
This End-User License Agreement (“Agreement”) is between you and Marathon Myanmar Co., Ltd. (“Company”, “we”, “us”) and covers your use of the MDAS POS app on web, Android and iOS (the “App”). By downloading, installing or using the App, you agree to this Agreement. If you do not agree, do not download or use the App.
The App is licensed, not sold, to you.
Who may use the App
You must be 18 or older and use the App on behalf of a business that has an MDAS account. You are responsible for keeping your sign-in details private and for activity under your account.
License
We grant you a revocable, non-exclusive, non-transferable, limited license to install and use the App on devices you own or control, solely to run your business’s operations with MDAS, in line with this Agreement.
Restrictions
You agree not to, and not to let others:
- copy, modify, decompile or reverse engineer the App, except where law allows;
- sell, rent, sublicense or otherwise transfer the App;
- remove or alter any copyright, trademark or other notice;
- use the App unlawfully, or to interfere with its security or with MDAS.
Device permissions and saved files
The App may ask to use your camera (to scan barcodes) and your storage or photo library (to save invoices as PDF files and images). You can refuse or withdraw these permissions in your device settings; some features will not work without them.
Invoices and images you save are stored on your device and may contain customer information. You are responsible for keeping them secure, sharing them only as allowed by law, and deleting them when no longer needed. We are not responsible for files after they are saved to or shared from your device.
Your data and privacy
Your business owns the data it records in the App. We handle personal information as described in our Privacy Policy.
Third-party services
The App may work with third-party services, such as payment providers and app stores. We are not responsible for those services, and your use of them is subject to their own terms.
Updates and support
We may update the App to fix problems or add features, and some updates may be needed to keep using it. Support for the App is provided by us, not by Apple or Google.
Termination
This Agreement lasts until ended by you or us. We may suspend or end it at any time, including if you break it. You can end it by deleting the App from your devices. When it ends, you must stop using the App.
No warranties
The App is provided “as is” and “as available”, without warranties of any kind, to the fullest extent allowed by law. We do not promise that the App will be uninterrupted, error-free or meet every requirement.
Limitation of liability
To the fullest extent allowed by law, we are not liable for indirect, incidental or consequential damages, including lost profits or data, arising from your use of the App. Our total liability is limited to the amount you paid for the App.
Apple App Store and Google Play
If you got the App from the Apple App Store:
- This Agreement is between you and us only, not Apple. We, not Apple, are responsible for the App and its content.
- Your use of the App must also follow the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
- We, not Apple, are responsible for any claims relating to the App, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims.
- You confirm you are not in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.
If you got the App from Google Play, your use is also subject to the Google Play Terms of Service.
Changes to this Agreement
We may update this Agreement. For material changes we will give reasonable notice. By continuing to use the App after changes take effect, you accept the updated Agreement.
Governing law
This Agreement is governed by the laws of Myanmar.
